(“MemberHub,” “we,” or “us”) collect, use, and share information about you when you use Product Fundraisers/Featured Products on www.memberhub.com, and any related applications we make available to access the Product Fundraisers/Featured Products platform that link to this Privacy Policy (collectively, the “Services”), including information that identifies, or that can be used to identify or contact you (“Personal Information”), and the choices that you have regarding that information.

Please take a moment to read this Privacy Policy to learn about our information collection practices and how they may affect you when you use our Services, whether as a non-registered user of our websites, as a user who has created an account and uses our Services to purchase offers and support causes (a “Registered User”), or as the representative of a business or a cause that uses the Product Fundraisers/Featured Products platform.

The information we collect, and how we use it, depends on the context of your interactions with us, the choices you make, and the Services and features you use.

Information You Provide to Us Directly

You may choose to provide certain information to us when you use the Services. The categories of information we collect through this method are summarized below

Contact Information

We collect Personal Information that you submit to us through contact forms that we make available through the Services to inquire about the Services and to request support for your use of the Services. This information may include Personal Information such as your name, your email address, your state of residence, and any information you submit as part of your inquiry or request.

If you represent a cause or a business, the information you provide may also include the name of your organization, your role in the organization, and any other information you submit as part of your inquiry or request.

User Account Information

When you register to create an account and become a “Registered User” of the Services to view and purchase offers we make available through the Services, we will ask you to provide your email address and create a password to access your account.

We will also ask you to select a local cause to benefit from your purchases through the Services, and will collect information you submit to search for and select a cause, which may include your city, zip code, and/or cause name.

Order and Payment Information

If you make a purchase through the Services, we will collect the details of your order and any information necessary to fulfill it, such as your mailing address and telephone number, and your payment and billing information, including information such as your payment card number, expiration date, and security code.

Your payment and billing information are processed by a third-party payment processor. MemberHub does not store payment card details, and no one in our company has access to your payment card or other billing or financial account information.

Cause and Business Account Information

If you use the Services on behalf of a cause or business, we will ask you to set up an account. The information we collect to set up your cause or business account may also include your contact details such as your name, email address, and telephone number; the name and address of your cause or business and a description of your cause or your business’s products and services; and your payment account details to facilitate the collection and receipt of payments associated with transactions made through the Services.

Information We Collect Automatically

We collect certain information automatically when you use the Services. This information may include technical information about your computer, device, hardware, or software you use to access the Internet or the Services, such as Internet Protocol (“IP”) address or other transactional or identifier information for your device (such as device make and model, information about device operating systems and browsers, or other device or system-related specifications); usage information and statistics about your interaction with the Services, which may include the URLs of the pages that you have visited, URLs of referring and exiting pages, page views, time spent on a page, number of clicks, the application you used, how long you used the application and when, and other usage statistics; information that facilitates a safer and more personalized experience, such as user identification information, saved preferences, and device identifiers or usage information for authentication and fraud prevention purposes.

We may also collect information about your location, including your approximate location, which we may derive from device information such as your IP address, and, if you agree, more specific location information that is provided through the GPS functionality on mobile devices used to access the Services. We will use this location information to customize the Services, including offers that are shown to you when you use the Services.

When you launch any of our Services from a mobile device, we also collect your device type, the unique device ID for your mobile device (“Device ID”) and IP address, if applicable. We use the Device ID to make it possible to authenticate and understand use of our Services.

How We Use Your Information

We may use information that we collect about you or that you provide to us, including any personal information, for the following purposes:

  • responding to your inquiries and fulfilling your requests;

  • operating, developing, and improving the Services;

  • Providing you with interest-based ads, push notifications, communications, and offers for products and services from us and the businesses and causes with whom we work, including based on your precise geolocation;

  • facilitating and fulfilling orders and processing payments;

  • performing our obligations under our agreements with businesses and causes, including billing and collections;

  • providing support for your use of the Services;

  • communicating with you about the Services, including about updates, alerts, reminders and other administrative and transactional matters, including on behalf of our business partners;

  • analyzing usage trends and measuring the effectiveness of the Services and our advertisements and communications;

  • performing analytics and conducting customer research;

  • complying with legal or regulatory requirements, judicial process, and our company policies (including due diligence and contracting activities);

  • securing the Services, including protecting against and responding to fraud, illegal activity (such as incidents of hacking or misuse of the Services), and claims and other liabilities, including by enforcing our Terms of Use;

  • evaluating or conducting a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business, assets or stock; and

We may also use your personal information to create anonymous or aggregated information that does not, and cannot be used to identify you, and use such information for any lawful purpose.

How We Share Your Personal Information

To accomplish the purposes set out above, we may disclose your information to third parties that may include:

  • our subsidiaries and affiliates;

  • contractors, service providers, and other third parties we use to support our business and the Services, including our payment processors;

  • the businesses that make offers available through the Product Fundraisers/Featured Products platform, when you purchase their offers;

  • other businesses and organizations with whom we partner to operate co-branded electronic storefronts and subdomains that we operate together with, or on behalf of, those businesses or organizations (“Affiliate eStores”), when you visit or purchase offers through those Affiliate eStores;

  • other users of the Product Fundraisers/Featured Products platform, if you submit reviews or comments on Product Fundraisers/Featured Products offers to the Services;

  • a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business, assets, or stock;

  • third parties when to comply with any court order, law, or legal process, including to respond to any government or regulatory request, and to enforce or apply our terms of use and other agreements, including for billing and collection purposes;

  • third parties to whom we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our clients, or others; and

  • any other parties with your consent or at your direction, such as when you use any features we make available within the Services to share information about our offers and your purchases through social media platforms.

We may also disclose aggregated information about our users, and information that does not identify any individual, without restriction.

How We Use Cookies and Other Tracking Technologies

We also collect information about your use of the Services through tracking technologies such as cookies and web beacons. A “cookie” is a unique numeric code that is transferred to your computer to track your interests and preferences and to recognize you as a return visitor. A “Web beacon” is a transparent graphic image placed on a website, email, or advertisement that enables the monitoring of things such as user activity and site traffic.

Some content or applications, including advertisements, on the Services are served by third parties, which may include advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or along with web beacons or other tracking technologies to collect information about you when you use the Services. For instance, we use Google Analytics. Google Analytics uses cookies to help us analyze how visitors use the Service. The information third parties collect through cookies and web beacons may be linked to your Personal Information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. Use of Services by Children

MemberHub does not knowingly collect information from, or provide any of our Services to, children under the age of 13. Nor do we target our Services to children under these ages.

Your Choices Regarding Your Personal Information

We provide you with choices regarding your Personal Information.

You can browse our websites without registering or directly submitting any information to us. We may collect some limited information automatically, as described above.

You may opt out of receiving our email messages by using the unsubscribe links provided in those messages. You can also manage your communications preferences on your account profile page.

As a Registered User, you may review, update, or delete information within your Profile through the Services by logging into your account. You may also email us at support@memberhub.com to request to review or make changes to other Personal Information that we have collected about you, or to request that we delete your Personal Information. We will use commercially reasonable efforts to honor your request unless otherwise required to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service and take other actions permitted by law.

You can accept or decline cookies. The Services do not currently respond to browser “do not track” signals, so you will need to use your browser settings to effectively manage cookies. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, you may find that certain features or functions will not work as intended.

Links to Other Websites; Affiliate eStores and Subdomains

Our Services may contain links to other websites and online services. If you choose to click on an advertisement or another third-party link, you may be directed to that third party’s website or service. The fact that we link to a third-party website or service is not an endorsement or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third-party websites or services. These other websites or services may place their own cookies or other files on your computer or mobile devices, collect data or solicit personal information from you. Other websites and services follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites and services you use.

The Services may also include Affiliate eStores, or other co-branded subdomains, that we operate together with, or on behalf of, our third-party business partners. When you visit these Affiliate eStores or other co-branded subdomains, we may disclose the information we collect from and about you to these third-party business partners, and they may collect information from and about you directly. These third-party business partners have their own privacy policies, which may differ from this Privacy Policy. We encourage you to review their privacy policies to learn more about how they handle the information they collect or receive when you visit Affiliate eStores and co-branded subdomains.

If you are located outside the United States and choose to provide Personal Information to us, we transfer Personal Information to and process it in the United States. Your use of the Services and submission of Personal Information to us represents your agreement to that transfer.

California’s “Shine the Light” law, S.B. 27, California Civil Code Section 1798.83, permits California residents who have an established business relationship with us to request certain information regarding our disclosures of their personal information (as defined by that law) during the preceding year, if any, to third parties for those parties’ own direct marketing purposes.
